These Terms govern your use of RigorMD. Plain-English headings, binding text.
These Terms of Service (the “Terms”) form a binding agreement between you and Abigail MD, Inc., a Delaware corporation, doing business as RigorMD (“RigorMD,” “we,” or “us”). By creating an account, submitting a manuscript, or otherwise using the service, you agree to these Terms and to our Privacy and Security & confidentiality notices. If you do not agree, do not use the service. If you use the service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
RigorMD produces an automated, severity-scored methodological and statistical assessment of a clinical research manuscript before journal submission. Two independent engines appraise the manuscript, a deterministic layer recomputes statistics where the reported numbers allow, and findings are grounded in your own text.
It flags. It does not certify. A report is guidance based on the submitted materials — it is not a guarantee of journal acceptance, a substitute for peer review, a certification of research validity, or medical advice. Decisions about your manuscript, and about patient care, remain yours.
Upload only manuscripts you have the right to share, de-identified as you would for journal submission. Every upload is screened for patient identifiers; that screening is advisory and recorded, and you attest to de-identification before payment — the attestation is a warranty you make to us, and uploads that breach it are your responsibility. Files that fail security screening or exceed resource caps are rejected and not processed. Do not probe other tenants' data or attempt to circumvent access controls. Use the service lawfully.
Language. RigorMD appraises manuscripts written in English. The statistical and methodological checks are built for English-language text, so we cannot produce a reliable review of a manuscript in another language.
Reports are priced per report and paid at checkout through Stripe. Processing is fully automated and not instant: reports are delivered by email and in your dashboard when ready. Institutional licensing is arranged separately.
If we cannot deliver a usable report for a paid submission — for example a file that fails security screening, a package we cannot read, or a processing failure on our side — the report fee is refunded in full to your original payment method. Refunds for delivered reports are at our discretion.
When work starts, and what that means for cancelling. We begin processing as soon as your payment clears — that is what you are asking us to do when you confirm. Some countries give you a right to cancel an online purchase within 14 days. That right ends once we begin, and you tell us to begin on a separate checkbox at confirmation, before you pay. The refund protection above is unaffected: if we cannot deliver a usable report, you are refunded in full.
You retain all rights to the manuscripts and materials you upload and to any work you create from a report. You grant RigorMD only a limited, non-exclusive license to process your files for the sole purpose of producing and delivering your report, and to retain them for the defined retention window described in Security & confidentiality. We do not claim ownership of your manuscript or your report, and we do not use your manuscripts to train models.
Your local consumer rights come first. Nothing in these Terms excludes, restricts, or modifies any consumer right or guarantee that applies to you under the law of your country of residence and cannot lawfully be excluded. Where anything below conflicts with those rights, those rights win.
Governing law. These Terms, and any dispute arising out of or relating to them or to your use of the service, are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules.
As is; no warranty. The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. RigorMD does not warrant that a report is complete, error-free, or that acting on it will result in journal acceptance.
Limitation of liability. To the fullest extent permitted by law, RigorMD's total liability arising out of or relating to your use of the service is limited to the amount you paid for the report at issue. RigorMD is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, data, or goodwill, even if advised of the possibility of such damages.
Indemnification. You will indemnify, defend, and hold harmless Abigail MD, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your manuscripts or materials, your breach of these Terms, or your violation of any law or the rights of a third party.
Out of court. Any dispute, claim, or controversy arising out of or relating to these Terms or to your use of the service will be resolved confidentially and out of court, as set out in this section, rather than in court.
Mediation first. Before commencing arbitration, the parties will first attempt in good faith to resolve the dispute through confidential mediation, on terms the parties reasonably agree, for a period of at least thirty (30) days after written notice of the dispute.
Binding arbitration. If the dispute is not resolved through mediation, it will be settled by final and binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be seated in Wilmington, Delaware, conducted in English before a single arbitrator, and kept confidential. Judgment on the award may be entered in any court of competent jurisdiction.
Class-action and jury-trial waivers. Disputes will be resolved only on an individual basis. You and RigorMD each waive any right to bring or participate in a class, collective, consolidated, or representative action, and each waive any right to a trial by jury.
Carve-outs. Either party may bring an individual claim in small-claims court if it qualifies, and either party may seek injunctive or other equitable relief in court to protect its intellectual property or confidential information. These carve-outs aside, the parties agree to resolve disputes out of court as described above. Nothing in this section overrides the local consumer rights described in §07.
We may suspend or terminate your access to the service, in whole or in part, if you breach these Terms, misuse the service, or create risk or legal exposure for us or other users, with notice where practicable. You may stop using the service at any time. Sections that by their nature should survive termination, including your manuscript rights, disclaimers, limitation of liability, indemnification, dispute resolution, and the general provisions below, survive.
We may update these Terms from time to time. When we do, we will revise the “Last updated” date and version shown at the top of this page. Material changes take effect when posted, and your continued use of the service after the effective date means you accept the revised Terms. If you do not agree to the revised Terms, stop using the service.
Entire agreement. These Terms, together with the Privacy and Security & confidentiality notices referenced in them, are the entire agreement between you and Abigail MD, Inc. regarding the service and supersede any prior understanding on that subject.
Severability. If any provision of these Terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets. These Terms bind and benefit the parties' permitted successors and assigns.
No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
